Delta 8-THC legal in Switzerland?

Hello everyone,
Unfortunately, my knowledge of chemistry and law is too limited to judge whether delta 8-THC is legal in Switzerland.
I found the following here (translated into English):

Synthetic cannabinoids
Any substance (other than controlled substances of Schedules a, b, d and f) whose structure is derived from indole,
regardless of the substitution of a further carbon atom of the indole structure by a nitrogen atom, by substitution:

– at the nitrogen atom (position 1) with alkyl, alkenyl, aryl or heterocyclic structures with at least 3 carbon atoms;

and additionally

– at position 3 of the indole by a carbonyl, carboxylic acid ester or carboxylic acid amide structure, which is additionally further substituted in any type and to any extent and can be fused to the indole structure.
These structures can be substituted in any way and to any extent at positions 2, 4, 5, 6 and 7 of the indole structure.

Synthetic cannabinoids 2

Any substance (excluding controlled substances of schedules a, b, d and f) whose structure is derived from
6H-benzo(c)chromen-1-ol (6H-dibenzo(b,d)pyran-1-ol), independently on the degree of hydrogenation of the non-phenolic benzo ring, by substitution:

– at positions 3, 6 and 9 by any alkyl groups.

Is delta 8-THC a synthetic cannabinoids, according to one of the top two criteria?

I am nearly certain delta 8 is not a Synthetic . Am I wrong?

It occurs naturally in weed but only in the 0.1% range.

Delta 8-THC in Switzerland is a bit of a gray area. While CBD and some cannabis products are legal, Delta 8-THC isn’t exactly clear-cut under Swiss law. It’s not specifically banned, but it could be subject to restrictions, especially if it contains higher levels of THC.

D8 is semi synthetic...but not according to the synthetic cannabinoid law above, as THC isn't an indole, but the synthetics are, like jwh compounds, etc, they all start with an indole
